Both the Consumer Protection Notice and the Seller’s Disclosure Notice have been updated by the 88th Texas Legislature. These changes affect real estate brokers, agents, inspectors, easement or right-of-way agents, buyers, and sellers.
Consumer Protection Notice
Real estate professionals, including brokers, agents, inspectors, and easement or right-of-way agents, must post the updated Consumer Protection Notice online and at their place of business. The updated Consumer Protection Notice no longer references the real estate inspection recovery fund.
How to update the Consumer Protection Notice on your website
You don’t have to do anything if your website links to the Consumer Protection Notice on the TREC website. The updated form has been uploaded to the same URL.
You must upload the new form if you have a PDF version of the Consumer Protection Notice on your website. Here is the link.
How to update your posted Consumer Protection Notice at your place of business
Real estate professionals must print and post the new Consumer Protection Notice at their place of business. Here is a link to the PDF.
Seller’s Disclosure Notice
Sellers in Texas must now disclose the type of piping used for gas supply lines (black iron pipe, copper, or corrugated stainless steel tubing).
If the seller doesn’t know the type of piping used for their property’s gas supply lines, they can indicate “unknown” on the disclosure notice.
However, more sellers will have access to this information over time since inspectors must now note the type of fuel gas piping on their reports.
